ELEVATOR MAINTENANCE AND OPERATION REGULATIONS
Annual inspection
ARTICLE 10 – (Amended: Official Gazette-5/11/2011-28106)
(1) Annual inspection of each elevator shall be carried out by a Type A inspection organization, by the relevant administration to which the building is affiliated, at the end of the first year from the date the elevator is put on the market, and at least once a year thereafter.
(2) During the stage of determining the Type A inspection organization for the annual control activities, the relevant administration to which the building is affiliated makes the necessary announcements and receives applications.
(3) The suitability of the Type A inspection organization is examined by the relevant administration based on the applications received, taking into account criteria such as the scope of its accreditation, the suitability of its professional liability insurance which is arranged to cover periodic control and inspection issues, the number of inspection chiefs and inspection personnel it employs full-time, the periodic control fee, and the general condition of the equipment kept ready for use in periodic control.
(4) With the assignment contract to be signed between the Type A inspection organization determined as a result of the examinations and the relevant administration, the Type A inspection organization is authorized to do annual inspection work on elevators and the necessary announcements are made to the public.
(5) During the contract period stipulated in the protocol to be signed between the Type A inspection organization and the relevant administration, the continuity of the accreditation and professional liability insurance of the Type A inspection organization is ensured.
(6) In cases where professional liability insurance is not maintained, accreditation is suspended or cancelled, the authorization of the Type A inspection organization is terminated by the relevant administration and the necessary announcements are made.
(7) The responsibility for ensuring the preparation of the annual inspection report and paying the annual inspection fee rests with the building manager of the building where the elevator is located.
(8) The annual inspection fee to be requested from the building manager within the scope of annual inspection activities is determined and announced by the relevant administration.
(9) Annual inspection is carried out under the supervision of the elevator installer or its authorized service responsible for the maintenance of the elevator.
(10) Compensation for any damage to the elevator during the annual inspection phase is covered by the professional liability insurance of the Type A inspection organization.
(11) The inspection report to be issued by the Type A inspection organization is prepared in triplicate, and one copy is kept by the relevant administration, the maintenance company, and the building manager.
(12) If the building manager does not allow the annual inspection of the elevator, the Type A inspection organization will notify the relevant administration to which the building is affiliated and ensure that it is taken out of service until the annual inspection is carried out.
(13) If, as a result of the annual inspection, there is a danger to life and property safety in the operation of the elevator, the operation of the elevator is not permitted until life and property safety is ensured. Nevertheless, the building manager is responsible for the operation of the elevator.
(14) The relevant administration is responsible for checking whether the annual inspection has been carried out.
(15) In the event of an accident in the elevator, the annual inspection is repeated.
(16) Statistical information regarding the annual control activity is recorded by the relevant administration and kept open to the Ministry.
